SEC. _07. PRECLUSION OF SOCIAL SECURITY CREDITS FOR YEARS PRIOR TO ENUMERATION.
(a) INSURED STATUS."Section 214 of the Social SecurityAct (42 U.S.C. 414) is amended by striking subsection
(c) and inserting the following:''(c)(1) Except as provided in paragraph (2), for purposesof subsections (a) and (b), no quarter of coverageshall be credited for any calendar year beginning on orafter January 1, 2004, with respect to an individual whois not a natural-born United States citizen, unless theCommissioner of Social Security determines, on the basisof information provided to the Commissioner in accordancewith an agreement entered into under subsection (d) or otherwise, that the individual was authorized to be employedin the United States during such quarter.''(2) Paragraph (1) shall not apply to an individualwho was assigned a social security account number priorto January 1, 2004..''(d) Not later than 180 days after the date of theenactment of this subsection, the Secretary of HomelandSecurity shall enter into an agreement with the Commissionerof Social Security to provide such information asthe Commissioner determines necessary to carry out thelimitation on crediting quarters of coverage under subsection
(c).''.
(b) BENEFIT COMPUTATION."Section 215(e) of theSocial Security Act (42 U.S.C. 415(e)) is amended"
(1) by striking ''and'' at the end of paragraph
(1);
(2) by striking the period at the end of paragraph
(2) and inserting ''; and''; and
(3) by adding at the end the following newparagraph:''(3) in computing the average indexed monthlyearnings of an individual, there shall not be countedany wages or self-employment income for any yearfor which no quarter of coverage may be credited tosuch individual as a result of the application of section214(c).''.
(c) EFFECTIVE DATE."The amendments made bythis section shall apply to benefit applications filed on orafter the date that is 180 days after the date of the enactmentof this Act based on the wages or self-employment.income of an individual with respect to whom a primaryinsurance amount has not been determined under title IIof the Social Security Act (42 U.S.C. 401 et seq.) beforesuch date.
