SEC. _. REPORTS ON BACKGROUND AND SECURITY CHECKS.
(a) REPEAL OF REPORT REQUIREMENT."The requirementset out in subsection (c) of section 216 thatthe Director of the Federal Bureau of Investigation shallsubmit the report described in such subsection is null andvoid and shall have no effect.
(b) REPORTS ON BACKGROUND AND SECURITYCHECKS."
(1) IN GENERAL."Not later than 180 daysafter the date of the enactment of this Act, theComptroller General of the United States, in conjunctionwith the Director of the Federal Bureau ofInvestigation, shall submit to the appropriate congressionalcommittees a report on the backgroundand security checks conducted by the Federal Bureauof Investigation.
(2) CONTENT."The report submitted underparagraph (1) shall include"
(A) a description of the background andsecurity check program;.
(B) an analysis of resources devoted to thename check program, including personnel andsupport;
(C) a statistical analysis of the backgroundand security check delays associated with differenttypes of name check requests, such asthose requested by United States Citizenshipand Immigration Services or the Office of PersonnelManagement, including"
(i) the number of background checksconducted on behalf of requesting agencies,by agency and type of requests (such asnaturalization or adjustment of status);and
(ii) the average time spent on eachtype of background check described undersubparagraph (A), including the time fromthe submission of the request to completionof the check and the time from the initiationof check processing to the completionof the check;
(D) a description of the obstacles that impedethe timely completion of such backgroundchecks;.
(E) a discussion of the steps that the Directorof the Federal Bureau of Investigation istaking to expedite background and securitychecks that have been pending for more thandays; and
(F) a plan for the automation of all investigativerecords related to the name check process.
(3) ANNUAL REPORT ON DELAYED BACKGROUNDCHECKS."Not later than the end of eachfiscal year, the Attorney General shall submit to theappropriate congressional committees a report containing,with respect to that fiscal year"
(A) a statistical analysis of the number ofbackground checks processed and pending, includingcheck requests in process at the time ofthe report and check requests that have beenreceived but are not yet in process;
(B) the average time taken to completeeach type of background check;
(C) a description of efforts made andprogress by the Attorney General in addressingany delays in completing such backgroundchecks; and.-
(D) a description of the progress that hasbeen made in automating files used in the namecheck process, including investigative files ofthe Federal Bureau of Investigation.
(4) AUTHORIZATION OF APPROPRIATIONS."There are authorized to be appropriated such sumsas may be necessary to carry out this subsection.
(c) APPROPRIATE CONGRESSIONAL COMMITTEES DE-FINED."In this section, the term ''appropriate congressionalcommittees'' means"
(1) the Committee on the Judiciary of the Senate;
(2) the Committee on Homeland Security andGovernmental Affairs of the Senate;
(3) the Committee on the Judiciary of theHouse of Representatives; and
(4) the Committee on Homeland Security of theHouse of Representatives.
