SEC. _. MEDICAL SERVICES IN UNDERSERVED AREAS. (a) FEDERAL PHYSICIAN WAIVER PROGRAM."Sec5tion 214(l) of the Immigration and Nationality Act (8U.S.C. 1184(l)), as amended by section 425(b), is furtheramended by adding at the end the following:''(5) In administering the Federal physician waiverprogram authorized under paragraph (1)(C), the Sec10retary of Health and Human Services shall accept applica11tions from"''(A) primary care physicians and physicianspracticing specialty medicine; and''(B) hospitals and health care facilities of anytype located in an area that the Secretary has des16ignated as having a shortage of physicians, includ17ing"''(i) a Health Professional Shortage Area
(as defined in section 332(a)(1) of the PublicHealth Service Act (42 U.S.C. 254e(a)(1)));''(ii) a Mental Health Professional Short22age Area;''(iii) a Medically Underserved Area (as de24fined in section 330I(a)(4) of the Public HealthService Act (42 U.S.C. 254c-14(a)(4)));.''(iv) a Medically Underserved Population
(as defined in section 330(b)(3) of the PublicHealth Service Act (42 U.S.C. 254b(b)(3))); or''(v) a Physician Scarcity Areas (as identifiedunder section 1833(u)(4) of the Social SecurityAct (42 U.S.C. 13951(u)(4))).''(6) Any employer shall be deemed to have met therequirements under paragraph (1)(D)(iii) if the facility ofthe employer is located in an area listed in paragraph
(5)(B).''.
(b) RETAINING AMERICAN-TRAINED PHYSICIANS INPHYSICIAN SHORTAGE COMMUNITIES."Section 201(b)(1) of the Immigration and Nationality Act (8 U.S.C.1151(b)(1)) is amended by adding at the end the following:''(F) Alien physicians who have completed servicerequirements under section 214(l).''.
