SEC. _. CLARIFYING AMENDMENTS REGARDING THE USE OF SOCIAL SECURITY CARDS.

(a) USE OF SOCIAL SECURITY CARDS TO ESTABLISHIDENTITY AND EMPLOYMENT AUTHORIZATION."Section274A of the Immigration and Nationality Act, as amendedby section 302, is further amended"

(1) in subsection (c)(1)"

(A) in subparagraph (B)"

(i) in clause (ii)(III), by striking '';or'' and inserting a semicolon;

(ii) in clause (iii), by striking the endperiod and inserting ''; or''; and

(iii) by adding at the end the following:''(iv) social security card (other thana card that specifies on its face that thecard is not valid for establishing employmentauthorization in the United States) that bears a photograph and meets thestandards established under section 716(d) of the Secure Borders, Economic Opportunity,and Immigration Reform Act of2007, upon the recommendation of theSecretary of Homeland Security, in consultationwith the Commissioner of Social.Security, pursuant to section 716(f)(1) ofsuch Act.''; and

(B) in subparagraph (D)(i), by striking''may'' and inserting ''shall, not later than thedate on which the report described in section716(f)(1) of the Secure Borders, Economic Opportunity,and Immigration Reform Act of2007, is submitted,''; and

(2) in subsection (d)(9)(B)(v)(I), by striking''as specified in (D)'' and inserting ''as specified insubparagraph (D), including photographs and anyother biometric information as may be required''.

(b) ACCESS TO SOCIAL SECURITY CARD INFORMATION."Section 205(c)(2)(I)(i) of the Social Security Act,as added by section 308, is further amended by insertingat the end of the flush text at the end the following newsentence: ''As part of the employment eligibilityverification system established under section 274A of theImmigration and Nationality Act, the Commissioner ofSocial Security shall provide to the Secretary of HomelandSecurity access to any photograph, other feature, or informationincluded in the social security card.''

(c) INCREASING SECURITY AND INTEGRITY OF SOCIALSECURITY CARDS."Notwithstanding any other provisionof this Act, section 305 of this Act is repealed..

(d) FRAUD-RESISTANT, TAMPER-RESISTANT, ANDWEAR-RESISTANT SOCIAL SECURITY CARDS."

(1) ISSUANCE."Not later than first day of thesecond fiscal year in which amounts are appropriatedpursuant to the authorization of appropriationsin subsection (g), the Commissioner of SocialSecurity shall begin to administer and issue fraud-resistant, tamper-resistant, and wear-resistant socialsecurity cards displaying a photograph.

(2) INTERIM."Not later than the first day ofthe seventh fiscal year in which amounts are appropriatedpursuant to the authorization of appropriationsin subsection (g), the Commissioner of SocialSecurity shall issue only fraud-resistant, tamper-resistant,and wear-resistant social security cards displayinga photograph.

(3) COMPLETION."Not later than the first dayof the tenth fiscal year in which amounts are appropriatedpursuant to the authorization of appropriationsin subsection (g), all social security cards thatare not fraud-resistant, tamper-resistant, and wear-resistant shall be invalid for establishing employmentauthorization for any individual 16 years of age orolder..

(4) EXEMPTION."Nothing in this section shallrequire an individual under the age of 16 years tobe issued or to present for any purpose a social securitycard described in this subsection. Nothing inthis section shall prohibit the Commissioner of SocialSecurity from issuing a social security card notmeeting the requirements of this subsection to an individualunder the age of 16 years who otherwisemeets the eligibility requirements for a social securitycard.

(e) ADDITIONAL DUTIES OF THE SOCIAL SECURITYADMINISTRATION."In accordance with the responsibilitiesof the Commissioner of Social Security under section205(c)(2)(I) of the Social Security Act, as added by section308, the Commissioner"

(1) shall issue a social security card to an individualat the time of the issuance of a social securityaccount number to such individual, which cardshall"

(A) contain such security and identificationfeatures as determined by the Secretary ofHomeland Security, in consultation with theCommissioner; and

(B) be fraud-resistant, tamper-resistant,and wear-resistant;.

(2) in consultation with the Secretary of HomelandSecurity, shall issue regulations specifying suchparticular security and identification features, renewalrequirements (including updated photographs),and standards for the social security cardas necessary to be acceptable for purposes of establishingidentity and employment authorization underthe immigration laws of the United States; and

(3) may not issue a replacement social securitycard to any individual unless the Commissioner determinesthat the purpose for requiring the issuanceof the replacement document is legitimate.

(f) REPORTING REQUIREMENTS."

(1) REPORT ON THE USE OF IDENTIFICATIONDOCUMENTS."Not later than the first day of thetenth fiscal year in which amounts are appropriatedpursuant to the authorization of appropriations insubsection (g), the Secretary of Homeland Securityshall submit to Congress a report recommendingwhich documents, if any, among those described insection 274A(c)(1) of the Immigration and NationalityAct, should continue to be used to establishidentity and employment authorization in the UnitedStates..

(2) REPORT ON IMPLEMENTATION."Not laterthan 12 months after the date on which the Commissionerbegins to administer and issue fraud-resistant,tamper-resistant, and wear-resistant cardsunder subsection (d)(1), and annually thereafter, theCommissioner shall submit to Congress a report onthe implementation of this section. The report shallinclude analyses of the amounts needed to be appropriatedto implement this section, and of any measurestaken to protect the privacy of individuals whohold social security cards described in this section.

(g) AUTHORIZATION OF APPROPRIATIONS."Thereare authorized to be appropriated such sums as may benecessary to carry out this section and the amendmentsmade by this section..
