SEC. _. PREEMPTION. In section 274A(i) of the Immigration and NationalityAct, as amended by section 302(a) of this Act, strikeparagraph (2) and insert the following:''(2) PREEMPTION."This section preempts anyState or local law that"''(A) requires the use of the EEVS in amanner that"''(i) conflicts with any Federal policy,procedure, or timetable; or''(ii) imposes a civil or criminal sanction
(other than through licensing or othersimilar laws) on a person that employs, orrecruits or refers for a fee for employment,any unauthorized alien; and''(B) requires, as a condition of conducting, continuing, or expanding a business,that, to achieve compliance with subsection (a) or (b), a business entity"''(i) shall provide, build, fund, ormaintain a shelter, structure, or designatedarea at or near the place of business of theentity for use by"''(I) any individual who is not anemployee of the business entity whoenters or seeks to enter the property.of the entity for the purpose of seek2ing employment by the entity; or''(II) any contractor, customer,or other person over which the busi5ness entity has no authority; or''(ii) shall carry out any other activityto facilitate the employment by others of"''(I) any individual who is not anemployee of the business entity whoenters or seeks to enter the propertyof the entity for the purpose of seek12ing employment by the entity; or''(II) any contractor, customer,or other person over which the busi15ness entity has no authority.''..
