SEC. _. CERTIFICATION REQUIREMENT. (a) IN GENERAL."A petition by an employer for anyvisa authorizing employment in the United States may notbe approved until the employer has provided written certification,under penalty of perjury, to the Secretary ofLabor that"
(1) the employer has not provided a notice ofa mass layoff pursuant to the Worker Adjustmentand Retraining Notification Act (29 U.S.C. 2101 etseq.) during the 12-month period immediately precedingthe date on which the alien is to be hired;and
(2) the employer does not intend to provide anotice of a mass layoff pursuant to such Act.
(b) EFFECT OF MASS LAYOFF."If an employer providesa notice of a mass layoff pursuant to such Act aftera visa described in subsection (a) has been approved, suchvisa shall expire on the date that is 60 days after the dateon which such notice is provided.
(c) EXEMPTION."An employer shall be exempt fromthe requirements under this section if the employer provideswritten certification, under penalty of perjury, thatthe total number of the employer's employees in theUnited States will not be reduced as a result of a masslayoff..
