Note that contractors/subcontractors are only required to adhere to immigration law and EEVS if the Secretary desires it. Further, unless the Secretary desires otherwise, the information of whether those contractors are registered with EEVS will not be available to those hiring the contractors.
This is a massive hole. Effectively the act allows 1099 employment to go under the radar as it is now unless a fit of pique hits the Secretary. Expect to see the 'traditional' businesses that hire illegals all shift from W-2's to 1099's in short order to get around this.
The fun catch is that a contractor must 'know' that they employed an illegal. But without a final determination with EEVS (which they're exempted from using) they cannot 'know'. More useless pablum in this dreadful novel.
