Overcriminalization

"Overcriminalization" describes the trends in America - and particulary in Congress - to use the criminal law to "solve" every problem, punish every mistake (instead of making proper use of civil penalties), and coerce Americans into conforming their behavior to satisfy social engineering objectives.

A bill to direct the Federal Trade Commission to revise the Telemarketing Sales Rule to explicitly prohibit the sending of a text message containing an unsolicited advertisement to a cellular telephone number listed on the national do-not-call registry.

Analysis

Would require the Federal Trade Commission to prohibit text-message solicitations to mobile phones that are listed in the “do-not-call” registry. Violations may be subject to criminal prosecution under the FTC Act.
