Overcriminalization

"Overcriminalization" describes the trends in America - and particulary in Congress - to use the criminal law to "solve" every problem, punish every mistake (instead of making proper use of civil penalties), and coerce Americans into conforming their behavior to satisfy social engineering objectives.

Analysis

This bill would amend maritime drug enforcement law to specifically prohibit the knowing or intentional operation of or embarkation in submarines that are without nationality and have crossed international boundaries. The penalties for violations are unclear. The current statute points to the penalty section of the Comprehensive Drug Abuse Prevention and Control Act of 1970, which appears to lack an applicable provision.
