The ''Waters of the United States'' Proposed Rule: Is It a Federal Power Grab?

On April 21, 2014, the Environmental Protection Agency and U.S. Army Corps of Engineers published a proposed rule that would define the scope of their jurisdiction under the Clean Water Act (CWA) through a new definition of “waters of the United States.” Recent Supreme Court cases have struck down past agency efforts to broadly interpret this language. Now, the agencies are back again with a new definition, but there is significant criticism that once again the EPA and the Corps are going too far by trying to expand their power.
