Dereliction of Duty: State Attorneys General Failing to Defend Marriage Laws in Court

State marriage laws across the country are facing constitutional challenges in the wake of last year’s Supreme Court decision in United States v. Windsor, which struck down part of the federal Defense of Marriage Act. Several state Attorneys General have publicly announced that they will not defend their state laws against such legal challenges, and United States Attorney General Eric Holder recently came out in support of these state officials.
