"Overcriminalization" describes the trends in America - and particulary in Congress - to use the criminal law to "solve" every problem, punish every mistake (instead of making proper use of civil penalties), and coerce Americans into conforming their behavior to satisfy social engineering objectives.
S 2711: Worksite Enforcement Act of 2008
To improve the enforcement of laws prohibiting the employment of unauthorized aliens and for other purposes.
Would impose criminal penalties of up to $75,000 per illegal alien and 6 months imprisonment, in total, on employers that engage in a pattern or practice of hiring or recruiting illegal aliens “knowing or with reckless disregard that the alien is an unauthorized alien with respect to such employment.” In addition, the legislation would criminalize possession, use, distribution, or production of Social Security numbers knowing the number to be forged or stolen. Such violations would be subject to Title 18 fines and imprisonment of up to five years.
