"Overcriminalization" describes the trends in America - and particulary in Congress - to use the criminal law to "solve" every problem, punish every mistake (instead of making proper use of civil penalties), and coerce Americans into conforming their behavior to satisfy social engineering objectives.
HR 4119: Border Tunnel Prevention Act of 2012
A bill to reduce the trafficking of drugs and to prevent human smuggling across the southwest border by deterring the construction and use of border tunnels.
This bill would add more criminal provisions to the federal criminal statute on border tunnels and crossings. Additional offenses for attempt and conspiracy relating to the border tunnel crimes would be added. The penalties for these would also be the same as the completed offenses.
This bill is similar to S. 1236.
