Federal DOMA in 1996: As a member of the House, this senator voted for the federal DOMA in 1996. The senator was appointed to the Senate in 2004, therefore not present for the Marriage Protection Amendment (MPA) in 2004. The senator voted against the MPA in 2006.
Senator's Comments: Menendez "believes marriage is a union between a man and a woman, but he opposes the constitutional amendment because he believes each state should be allowed to formulate its opinion on its own, without federal intervention." He also ?believes that no couple, regardless of gender, race, ethnicity, or sexual orientation should be denied the rights and privileges that are currently legally incorporated into the institution of marriage," such as health care or the right to inherit assets. ?Sen. Frank R. Lautenberg said any state should have the right to recognize same-sex marriages. But, he said, ?because I believe that such a decision implicates deeply held religious, moral, and ethical decisions, I also believe that the people of each state must be permitted to make that decision for themselves.?
